- Law on Information and Electronic Transactions (UU ITE) were recently revised, will take effect from today, Monday (28/11/2016).
"Based on Law No. 12 of 2011, Article 73, a bill was passed through the signature of the President no later than 30 days after the House approved and the President," said the Chairman of the Working Committee (Panja) Bill ITE Henry Subiakto via short messages, Monday (28/11 / 2016).
"If it is not signed by the President within a period of 30 days from the time agreed upon, then the bill is legitimate and obligatory enacted into law," said Henry.
There are four changes in the new EIT Law.
First, the addition of Article right to be forgotten, namely article 26.
The article describes a person may file deletion related news himself in the past that have been completed, but was reinstated.
One of them a suspect who was proved innocent in court, then he is entitled to apply to court for reporting suspected him to be removed.
Second, the duration of imprisonment concerning defamation, insult and so reduced to under five years.
Thus, under Article 21 of the Criminal Procedure Code, a suspect during investigations should not be detained for only accused of minor criminal offenses which the penalty of imprisonment below five years.
Third, the interpretation of Article 5 related electronic documents as evidence of a valid law in court.
The new EIT Law following the Constitutional Court ruling stating electronic documents obtained through eavesdropping (interception) without the permission of the court is not valid as evidence.
Lastly, the addition of a new paragraph in Article 40.
In the verse, the government reserves the right to delete an electronic document that proved to disseminate information that violates the law. The information in question related to pornography, racial intolerance, terrorism, defamation, and others.
If a site that provides information in violation of the law is a media company, it will follow the mechanism in the Press Council.
However, if the sites that provide such information is not a legal entity and is not registered as a media company (nonpers), the government can directly block them.
"The approval of Parliament and the government to draft ITE has been done on October 27, 30 day means these days must be numbered in the Secretariat of State," said Henry again.
